NOW, 2 hr and 4 hr Emergencies are subject to availability.
THE NOW SERVICE
The NOW service guarantees our help desk back up service of Air Traffic Control , offering 15 minute update monitoring of operatives with tracking to site, arrival time and then updating to completion of task.
NECESSARY SURCHARGE
We are able to review the charging structure under our Terms and Conditions without notice, however rather than reassess and alter each type of callout charge, it has been more approprite at this time to apply a common surcharge This has been put in place at this time. This surcharge assists with offsetting the many increases in transport costs, various environmental levies and numerous other issues which have taken place over time, without the necessity of having to carry out a full review and we consider that in overall terms this will be more economic than changing the callout rates at this time.
NEW LEGISLATION ON LAMP WASTE DISPOSAL
End of life discharge lamps now need to be handled differently since the implementation of the Landfill Directive and the new Hazardous Waste Regulations throughout the UK.
As a contractor we have to register with the Environment Agency and produce a quarterly report on every consignment of hazardous waste made. This report is then sent to the Environment Agency and a charge is made which is now compulsory. This is mandatory and not optional and is in effect today! It is therefore necessary for us to pass on the charges to our customers at a rate of £0.85 per lamp 6ft and under, and £1.65 per lamp 8ft and over.
Therefore this charge will be incurred on all jobs with effect

Terms & Conditions

TERMS &
CONDITIONS


DEFINITIONS
In these conditions the Contractor means Norman (UK) Ltd, the Client means the company with whom the Contractor enters into a maintenance contract, whether written or not.
ACCEPTANCE
The placing of an order by or on behalf of the Client is deemed to be an acceptance by the Client of all the Contractor s terms and conditions of contract, including all rates. The Contractor s terms and conditions are the only such terms to apply to any contract between the Contractor and the Client.
RATES
All the Contractor s rates and call out/arrival charges are set out in the information brochure as supplied by the Contractor. The Contractor reserves the right to increase these rates and call out/arrival charges upon notice of same being given to the Client, and such rates and call out/arrival charges will be reviewed from time to time.
SAFETY
The Contractor is governed by extensive regulations (both statutory and otherwise) to carry out works safely. It is the Contractors policy that where circumstances dictate such a requirement, operatives will work in pairs. The Contractor therefore reserves the right to charge the Client for both operatives, where such regulations provide, or where the Contractor deems provision of such operatives to be necessary.
ESTIMATE
(a)
Where the Contractor is required by the Client to provide an estimate, such estimate shall be defined as the Contractor s best estimate for the completion of the works required on that particular job.

(b)
When an estimate is agreed, the Contractor undertakes to limit the total costs to the estimated cost (+VAT) unless the Contractor notifies the Client of the need to revise the estimate prior to completion of the work.

(c)
The Contractor only undertakes to comply with an estimate as in (b), provided that there is no deterioration in the state of repair of the premises and/ or concealed or latent defects becoming apparent following authorisation being given by the Client for the Contractor to complete the works.


CLIENT’S OBLIGATIONS
The Client shall provide to the contractor without charge an adequate light and water supply, power for portable tools, a site telephone where appropriate and facilities for the storage of plant tools, equipment and materials during the progress of the work at the site where the work is to be carried out.
MATERIALS
(a)
All materials specified are offered subject to the usual trade conditions imposed by the suppliers of such materials.

(b)
All samples submitted are only a fair example of such materials.

(c)
The Contractor reserves the right to substitute alternative materials of a comparative quality in the event that the originally specified materials are unavailable for whatever reason as and when required by the Contractor.

(d)
All unfixed materials provided by the Contractor shall remain the property of the Contractor until such time as the Client has made payment for all sums due or to become due under the contract.


WASTE SYSTEMS
The Contractor cannot accept any responsibility for waste systems which become blocked again within a short time of having been cleared to a state of free running.

 


TERMS & CONDITIONS

In the event that the Client prevents or impedes the Contractor in the execution of any works, or is in breach of any of these conditions, the Contractor reserves the right to adjust the contract price to the extent of any loss and expense thereby caused to the Contractor.
DELAY
In the event that any completion date is agreed between the Contractor and the Client, such completion shall be extended on application by any time lost to the Contractor due to any strikes, lockouts, variations, supplier or subcontractor delay or any other circumstances beyond the Contractor s reasonable control. In such circumstances the Contractor undertakes to use their best endeavours to complete the works with a minimum of delay.
DEFECTS LIABILITY
The Contractor will remedy any defects in the works which are the Contractor s responsibility within a reasonable time provided such defects are notified to the Contractor within six months of the completion of the works. The Contractor shall not be responsible for any defects whatsoever unless such defect is notified to the Contractor in writing immediately such defect becomes apparent to the Client.
AUTHORISATIONS
All accounts and completed works for reactive maintenance will be detailed and signed for on site. All paperwork relevant to the call out will accompany each invoice.
CONTRACTORS INVOICES
The Contractor will invoice the Client for all works within a reasonable time of the completion of same. Such invoices are deemed to be reasonable and due for payment unless the Client provides the Contractor with a written objection in respect of the same within 14 days of the date of the Contractor s invoice.
PAYMENT
(a)
Unless otherwise stated all the Contractor s rates and prices are exclusive of VAT.

(b)
The Contractor s invoices are due for payment within 30 days of the date of the invoice.

(c)
If credit is withdrawn all invoices are due for immediate payment.

(d)
The Contractor reserves the right to charge the Client interest on overdue accounts at base rate charged by the Bank plus 10% until date of payment.

(e)
The Client shall make all payments without any set off or discount or retention save as may have been previously agreed in writing or whatever nature, but payment of an invoice is not to be regarded as a waiver of any of the Client s rights with reference to defects properly notified to the Contractor.


DETERMINATION
The Contractor may give notice in writing to determine the Contract with the Client, without prejudice to any other rights of the Contractor if:
(a)
The Client fails to make any payment due to the Contractor (see ACCEPTANCE).

(b)
The Client commits any act of bankruptcy, or a petition for winding up is presented to the court or a receiver or administrator is appointed over any part of the Client s business, and in the event of determination as aforesaid the Client shall be immediately liable for all works undertaken, whether invoiced or not, and any loss or expense caused to the Contractor by any reason of the determination.

 


Health & Safety


The Health and Safety at Work Act 1974 makes provision for the Health and Safety and Welfare of everyone in the workplace.
As Employers are required under the Act to declare a written safety policy and to ensure that the means of effectively implementing the policy are set up.
Our Company Health & Safety Policy is stated below and the means of implementation will be developed as necessary to meet the full requirements of the Act.
POLICY STATEMENT
It is our Policy as a Company to provide working conditions and develop working practices that are safe, and to create an environment that is not injurious to the health of Employees in any way.
Health & Safety at work responsibility is a prime task for Management and Employees at every level, and safe working practices will have priority over all other operating requirements,
i.e. A job or task must not be carried out where there is a risk to Health & Safety.
Employees and Nationwide Associates are reminded that they have a duty, in law, as well as in common sense, to co operate with the Company by actively improving safety standards and taking care of themselves and others who may be at risk of injury.
Employees will be given Safety Rules in the aspects of their work.
Everyone is expected to work in accordance with the Safety Rules in such a way that accidents and injuries to themselves, and others are avoided.
The Safety Programme & Risk Assesment Procedure are constantly under review. The Safety Rules of Nationwide and its Associates are common Rules and apply to all Employees, Directors, Managers, Supervisors, Tradesmen, and all
Labourers, Mates and Trainees.
